AML / CTF · New Laws Effective 1 July 2026
AML/CTF for real estate
The new AML/CTF laws were really written for banks, but have been thrown at real estate agencies under Tranche 2.
Unfortunately, the new laws are here to stay.
The challenge is not simply with software or just obtaining ID’s - that’s the easy part. The difficulty is making the entire process work properly in a busy sales environment, where sales agents, administrators, buyers, sellers, contracts, trust monies and timeframes all move quickly.
Not many operations employees understand know how to examine trust deeds, ASIC extracts. Penalties will go into the thousands of dollars if the audit finds the work was not done properly or cannot be supported in writing.
Our RE AML/CTF service is built for real estate agencies. We go beyond software, templates and training - we take control top manage your compliance from setup to managing all daily AML checks needed using a process that fits around how your agency already operates.
In summary, we provide you peace of mind that it’s all being handled by a team that knows what to do.
Smarter AML/CTF
Beyond the platform & into supporting
As many agencies are now discovering, signing up to an AML platform is just the first step. But software suppliers will have little time for you when you need.
Your choices are:
Burn into your current onsite resources? Or
Outsource it & focus on giving better agent support
Real estate is different. The AML work sits directly inside new listings, offers, contracts and settlement timeframes.
The challenge is the volume that needs managing in a tight timeframe — dealing with sales agents, buyers and sellers, including multiple parties, entities and trust deeds.
The more compliance your operations team gets involved in, the less support your agents get.
Expertise that keeps you deal focussed
Beyond access to a platform, we offer a fully managed real estate specialised AML service —with the work delivery, support and access to our people all built in.
-
Tailored Policies and Procedures
AML policies & procedures are built specifically for your real estate business—not an off-the-shelf template. We consider your agency, people, clients and transactions to develop a practical framework that reflects how your agency actually operates.
-
We track all AML requirements across new listings, vendors, contracts and buyers as transactions arise. Our team monitors the daily workflow and follows up outstanding requirements, keeping your agency compliant without adding to its administrative workload.
-
We coordinate secure identity verification for all buyers and vendors, including company directors, trustees, attorneys and beneficial owners. Each party is verified through the approved platform, with records securely maintained and outstanding checks followed through to completion.
-
We complete ASIC searches, review company, trust and other supporting documents to identify directors, shareholders, trustees and beneficial owners. Complex ownership structures are carefully traced so the correct parties are identified and verified for AML purposes.
-
Our skilled team reviews contracts, funding arrangements, sale details and trust account deposits to identify unusual activity or inconsistencies. This includes examining the source of funds, payment movements and the parties involved, with any concerns escalated for further review.
-
As your team focuses on sales, we quietly conduct behind-the-scenes screening for politically exposed persons (PEPs), sanctions and adverse media.
-
We assess each customer and transaction against the agency’s AML risk framework. Identity, ownership structure, funding, geography, screening results and transaction activity are considered, with additional checks applied where the risk is higher.
-
Potential concerns and inconsistencies are documented and promptly escalated to the agency’s AML/CTF Compliance Officer. We support the review and further enquiries required so the matter can be assessed and acted upon without delay.
-
We support the agency with the preparation and submission of a Suspicious Matter Report to AUSTRAC. The process is carefully managed within the required reporting timeframes and tipping-off restrictions.
